A Pulrose man who broke his brother’s jaw in a fight has been fined £350.

Shaun William Kirby, of Oak Avenue, admitted being drunk and disorderly after his brother refused to make a complaint.

High Bailiff Jayne Hughes also banned the 40-year-old from entering licensed premises, and buying or being sold alcohol for three months.

Prosecuting advocate Roger Kane told the court that police were called to the area of Peel Road near Braddan church on July 10 at 1.30am after a report of two men fighting.

When officers arrived Kirby told them: ’I’ve had a fight with my brother.’

There was blood on the road and pavement and Kirby’s brother was taken to hospital with a suspected broken jaw.

This was confirmed at the hospital but he would not make a complaint against his brother or allow access to medical records.

When interviewed Kirby told police he had not intended to harm his brother but admitted causing the injury.

He said he was ’six or seven’ out of 10 on a scale of how drunk he was.

The court heard that he had a previous conviction in 2019 for being drunk and disorderly.

Defence advocate David Reynolds asked for credit to be given for his client’s guilty plea. He said: ’I’m told by Mr Kirby he had been at a house party and they were walking home when the incident took place. He tells me he has previously got himself into situations because of alcohol and says he has not drank since this.

’He has been to his GP and been referred to the Drug and Alcohol Team.

’He accepts his behaviour fell below the required standard and he is very lucky not to be before the court for far more serious offences.’

Mr Reynolds went on to say that the brothers had made up since the incident.

High Bailiff Mrs Hughes also ordered Kirby to pay £125 prosecution costs, which he will pay, along with the fine, at a rate of £50 per week.
