A man who flashed his penis at a woman in Tesco has been sentenced to probation.
Christopher James Christian, of Lord Street, admitted provoking behaviour as well as a separate offence of failing to provide a breath sample.
The 34-year-old, who has 55 pages of previous convictions, made the headlines last week after he was put on probation for three years at the Court of General Gaol Delivery after stealing a motorbike then burning it after he dumped it.
The provoking behaviour and breathalyser offences occurred in October and August last year but had been previously adjourned pending his sentencing at the higher court.
High Bailiff Jayne Hughes was critical that due to legal provisions in the island these two offences could not be sentenced at the Court of General Gaol Delivery with the other offences and had to be sentenced at the lower court.
Mrs Hughes sentenced Christian to a 12-month probation order and banned him from driving for 12 months.
Both sentences will run concurrently to the sentences imposed by Deemster Alastair Montgomerie at the Court of General Gaol Delivery.
Talking about the lower court offences, prosecutor Hazel Carroon told how a woman reported seeing Christian in Tesco with a group of men on October 11 at 5.45pm.
He was looking at her and she said that he then pulled down his trousers to expose his penis.
She turned and walked away but reported the incident which was captured on the store’s CCTV.
Christian was arrested and told police he was messing around with friends and hadn’t intended to expose himself.
The failure to provide a breathalyser sample occurred on August 9 when Christian was in Lord Street at 3am on suspicion of driving offences.
Police said it was evident he had been drinking but once at police headquarters he refused to take a breathalyser test saying: ’No, prove I was driving.’
Defence advocate Deborah Myerscough said: ’In the last two weeks Mr Christian has attended all probation appointments.
’This has also included unannounced visits to his home and drug testing.
’These two offences involved alcohol. He has written a letter to the lady who was in Tesco.’
Mrs Hughes said: ’It is ridiculous that you have been brought back to be sentenced now.
’I will make a concurrent probation order as that was most likely what would have happened.’
