An investigation into covenants on building at Bradda is being done by Port Erin Commissioners.

It follows a plan (19/01084/B) by Celumet Limited (Mr M. Jones) for alterations and extension to the first floor and erection of a two storey extension to the side elevation at Linksfield, Bradda West Road, Spaldrick.

The local authority placed covenants on development when it sold land in the 1960s and there are restrictions on various elements including the height.

Residents objected to the proposal, with concerns over an invasion of privacy due to the position of the windows on the north east elevation.

The height of the building would impact on light and it would be out of keeping with nearby properties, one said.

Another referred to the covenants placed with ’great thought and planning’. They have worked well for 56 years.

The plans are ’totally out of context with all the properties in the local area.’ Dormers that overlook properties ’should never be allowed’. A two-story extension to the north west elevation ’should not be even considered. This extension will take away our complete coastal view of the beach.’

They asked: ’If the deeds of the properties are to be ignored along with the covenants, why do we have them?’

At a recent meeting commissioners’ clerk Jason Roberts said they ’need a review done properly’, adding: ’ If anyone has breached covenants it’s not necessarily part of planning.

’There are probably issues with other properties.

’Maybe the covenant was lifted in parts. It would be sensible to take legal advice and explore the covenant issues.’

Commissioner Phil Crellin said: ’If they have not been enforced in the past we can’t start now. We should go for advice.’
