The occupant of a prominent glen-side home in Groudle is facing legal action over a failed private sewage treatment plant.
Anna Kawalek is being prosecuted for allegedly failing to carry out works to the private sewage treatment plant at Groudle Glen House, which Onchan Commissioners say posed a pollution risk to the environment.
The local authority served a notice on Mrs Kawalek in September 2015 under the Sewerage Act 1999, stating a ’private sewage treatment plant and associated pumps and pipework provided for the building is in a such a condition to be prejudicial to health or a nuisance’.
The notice was disputed so the notice period only ended in January this year. At the local authority’s latest meeting, members unanimously agreed to start a prosecution under Section 58 of the Local Government Act 1985.
Onchan Commissioners’ chief executive Michael Morrison said: ’There was one other action we could take, which was to go in and undertake the works.
’We didn’t feel that was fair because Onchan ratepayers would be left with the cost.
’That’s why we are taking action against the occupier.’
She is due to appear before Deputy High Bailiff Jayne Hughes on March 7. Under the Local Government Act, a maximum fine of £2,500 can be imposed upon conviction, as well as £40 a day until action is undertaken.
