A businessman has been banned from driving after admitting a charge of drink driving.
Brett Daniel Burton, 34, of Raad Kirree Varrey, Peel, was banned for three and a half years by High Bailiff Jayne Hughes when he appeared in court on Tuesday morning.
The court heard that Burton failed a breath test following a minor collision with another car at about 8.20pm on Athol Street, Peel, on July 10.
Prosecutor Barry Swain said that Burton had been drinking at The Creek public house where he had drunk ’multiple glasses of wine’.
He then drove to Athol Street to use an ATM machine but, when he parked up, he reversed into a parked Land Rover.
While the collision was at low speed and the car suffered minor damage and the police were called.
When officers arrived, Burton took and failed a roadside breathalyser test.
When he took one at police headquarters, he produced a reading of 94mg, the legal limit is 35.
Probation officer Sarah Proudlove conducted a stand-down report on Burton, at the request of his advocate Steve Wood and Mrs Hughes.
Mrs Proudlove said he has been ’under a great deal of stress’ because of ongoing issues with his business but that he ’offers no excuse for his behaviour’.
She added that Burton had been at lunch with a friend and had been discussing difficulties in their lives and that while he ’doesn’t recall’ getting into his car, he ’takes full responsibility for his actions’.
Burton was said to be ’deeply ashamed’, ’very remorseful’ and ’haunted by the thought he could’ve hurt someone’.
He was also said to feel that he’s let his family and work colleagues down and that he ’deserves to be punished’.
Mr Wood said his client is seeking assistance for the stress he has been under but he has the full support of his family and said his drink driving was a ’poor decision’ and a one off event.
In sentencing, Mrs Hughes said: ’Why you drove I don’t think you’ll be able to explain to yourself, let alone me.’
She added that while the damage was only minor ’you could’ve injured someone’.
However, she did give Burton credit for his early guilty plea and cooperation with the police.
Burton was banned from driving for a total of three-and-a-half years (42 months) and fined £1,500, he will also pay prosecution costs of £125.
If he does intend to drive after his ban, he will need to pass the extended driving test.
