A Douglas woman who had to be restrained using Pava spray has been sentenced to 40 hours of community service for resisting arrest.
Prosecutor Rachael Braidwood told the court how, on December 11 at 12.55am, Kate Louise Lowey, of Willaston Crescent, was in Jaks bar on Loch Promenade in Douglas.
She was asked to leave after the woman she was with fell asleep in the toilets.
As the women were ejected Lowey was said to have been shouting, swearing and trying to grab a mobile phone from one of the bouncers.
Police were called and dealt with Lowey, aged 24, outside the pub.
She was asked to put down a cigarette but refused and swore, saying: ’I’ve done nothing.’
Lowey was said to have been waving her arms around and attempted to walk away.
As officers tried to arrest her she collapsed her legs and kicked out, then dug her nails into an officer’s hand.
She was eventually restrained using the Pava Spray and arrested.
At police headquarters she handed in a prepared statement accepting that she had resisted arrest but saying she did not recall kicking out.
Lowey said she did not intend to cause any injuries and wanted to apologise.
A probation report said this was Lowey’s first offence and said she was unlikely to appear before the court again.
Advocate Roger Kane said his client was a ’hardworking lady’ who worked five evenings a week.
’This was completely out of character for her,’ said Mr Kane. ’There was a disagreement in Jaks with security staff. She felt they were being heavy-handed.
’She didn’t intend to hurt officers with her actions. She spent the night in cells and that in itself was a salutary lesson. We would ask the court to accept this was a one-off incident.’
