A delivery driver wept in court as he was spared a driving ban.

Davey John Stewart, of Murray’s Road, Douglas, was driving in Douglas when his car hit a motorbike, leaving the rider with a fractured foot and several broken toes.

Stewart, aged 41, was fined £600 for driving without due care and attention and his licence was endorsed with nine penalty points when he appeared in court on Thursday.

Magistrates heard that a ban would result in ’exceptional hardship’ for his family as he would lose his job, and said they would give him ’one final chance’.

The court heard how, on October 30 at 9.10pm, Stewart was driving a Suzuki Swift on Alder Road and travelled to the junction at Groves Road.

His car collided with a Yamaha motorbike which was travelling towards the National Sports Centre in Groves Road.

When interviewed by police Stewart admitted that the accident had been his fault.

He said he saw the bike at the last minute and it was too late to brake and avoid the collision.

Defence advocate James Peterson described the incident as an ’unfortunate accident’.

He said: ’Mr Stewart doesn’t wish to put a different spin on what happened.

’He works as a delivery driver for Star Grill, if he loses his licence he will lose his job. He wishes to apologise to the court and the motorbike rider who he struck.’

The court heard that Stewart was married with three young children and a mortgage.

He took the stand and gave evidence that a ban would result in ’exceptional hardship’.
