A father and son who assaulted a man outside the Albert pub in Douglas have been fined £750 each.
Damian Kevin Reilly pushed the man against a wall and his father, Kevin Paul Reilly, then punched him four times in the face.
The duo pleaded guilty to a joint charge of common assault and were also ordered to pay £125 prosecution costs each.
Prosecuting advocate Rachael Braidwood told the court that the victim was drinking in the Albert at Chapel Row near the old bus station on September 4 at 11.15pm.
He said that he went outside for a cigarette but was then ’rugby tackled’ by Damian Reilly, which sent him across the road.
Damian Reilly, who is 40, then pinned him against the wall while his 66-year-old father punched the man in the face four times.
The pair then left the scene but returned shortly afterwards and were arrested.
When interviewed, Damian Reilly, who lives at Chepstow Street, Liverpool, told police that he had drunk 16 brandies before going out and was ’extremely intoxicated’.
FALLEN OUT
He said that his father had fallen out with the victim previously.
Kevin Reilly, who lives in Homefield Close, Willaston, handed in a prepared statement saying that he had a previous dislike of the victim but felt embarrassed by his behaviour.
The court heard that Damian Reilly has a previous conviction for being drunk and disorderly in 2011 while his father has one for the same offence in 2004.
Defence advocate Paul Rodgers represented Kevin Reilly and said: ’Mr Reilly has a limited criminal record.
’He is a plasterer and had been on the island for decades with only one conviction.’
Mr Rodgers said that the victim had previously ’invited Mr Reilly outside’ on numerous occasions.
Sara-Jayne Dodge represented Damian Reilly and said that her client had been attending a family funeral so ’emotions were heightened’ due to the circumstances of the visit.
’My client’s involvement was limited to one push.
’There is some history but he should not have pushed the individual,’ said the advocate.
Magistrates chair Julian Ashcroft told both men: ’It seems that alcohol was a major contributor in these offences. Just because you don’t like somebody it is not a reason to assault them.’
Damian Reilly was ordered to pay his fine and costs forthwith or face 60 days in custody, while Kevin Reilly was ordered to pay at a rate of £100 per month.
