A man who had to be restrained using Pava spray as he struggled with police has been jailed for 10 weeks.
Jordan Declan John Caley, aged 22, of Mona Drive, in Douglas, admitted resisting arrest and provoking behaviour.
We previously reported how, on July 26 at 2.50am, the complainant in the case was at his home at Church Road Marina in Douglas.
He went to his neighbour’s flat to complain about loud music which was keeping him awake.
Caley was present at the flat and started swearing at the complainant telling him: ’You need to leave. What’s it got to do with you? You best go back to your room.’
The neighbour then got between Caley and the complainant to stop an altercation but as the man left Caley told him: ’I’ll see you around.’
The complainant called the police who then called at the address.
Caley was arrested but as he was being escorted outside he started struggling with police who eventually had to use Pava spray to restrain him.
Defence advocate Paul Glover said that his client was remorseful about his behaviour.
’He was very much caught up in the heat of the moment,’ said the advocate.
’He understands the police were only trying to do their job. There were no punches or kicks.’
Struggle
The court heard that Caley had been given two opportunities to meet with probation which may have resulted in the option of him being suitable for community service.
However, he had failed to attend meetings which meant sentencing options were limited.
Deputy High Bailiff Jayne Hughes said: ’There was no direct violence towards the police but you did resist to the extent Pava had to be sprayed and force used to put you in the back of the van.
’The offence is aggravated further by the fact you were intoxicated at the time.’
Caley was sentenced to four weeks for provoking behaviour and six weeks for resisting arrest, to run consecutively. He was banned from licensed premises and purchasing or being sold alcohol for four months.
