A 39-year-old Douglas man has been jailed for 16 weeks after breaching a suspended sentence.
Kenneth Andrew O’Connell, of Church Road Marina, was also sentenced to four weeks’ custody to run concurrently after admitting an offence of provoking behaviour.
Prosecutor Barry Swain told the court how, on November 14, O’Connell went to the home address of a woman with whom he was said to be in an ’on/off relationship’ with, after being released on bail for a different matter.
Once outside her home he began shouting and the woman telephoned 999.
When police arrived O’Connell had left but he was later arrested and charged with provoking behaviour which put him in breach of the earlier suspended sentence.
In a police interview, he handed in a prepared statement denying the offence but later admitted the breach.
Defending O’Connell in court his advocate Rebecca Cubbon said that her client had been on remand since November 15.
Ms Cubbon said: ’It was unfortunate Mr O’Connell didn’t heed the advice of the police. He was confused and upset at the time.
’Perhaps he didn’t deal with that upset in the best way. No threats were made to the victim, he shouted "Oi" to get her attention.
’This is a very turbulent relationship going on for many years now. He spent three months on remand earlier this year and then was found not guilty after a trial in relation to a different matter. Perhaps his choice of partner does cause him difficulties. The court will be considering activating the suspended sentence but we would ask that you do not, taking into account time spent on remand. He spent three months then six weeks.’
However, magistrates activated the suspended sentence, ordering O’Connell to be jailed for the 16 week term.
