A fight in the street between members of a party has resulted in a man being jailed.
Nathan Thomas Kelly, aged 32, of Bollan Drive, in Glen Vine, pleaded guilty to assault causing actual bodily harm and was found guilty of common assault after a trial.
He was jailed for 16 weeks when he appeared before Deputy High Bailiff Jayne Hughes for sentencing on Tuesday.
Police were called to Melbourne Street in Douglas at 1.30am on July 23 after reports that members of a wedding party were fighting in the street.
Kelly headbutted one man, knocking his tooth out and cutting his lip.
He pleaded guilty to assaulting one man but claimed it had been provoked and a Newton Hearing to establish the facts was held.
The hearing ruled that the assault was unprovoked.
He denied the common assault on a second man charge but was found guilty after a trial.
Defending Kelly in court his advocate Roger Kane said Kelly’s partner was pregnant and due to give birth to their first child in September.
Mr Kane said: ’The social enquiry report refers on a number of occasions to Mr Kelly’s struggle to manage his emotions.
’On the day in question he acted out of character,’ the advocate said.
In the last 10 years, through his own hard work and his partner’s, he has turned his life around.
’He is absolutely kicking himself he has put his future plans and his partner’s future in jeopardy by his actions.
’It’s clear his recollection has suffered as a result of his alcohol intake.
’He didn’t intentionally mislead the court.
’He remembers matters differently to how your honour found.
’He has had time since the trial to reflect on his actions. He lost control while under the influence of alcohol.’
Emotions
Mr Kane went on to say that there had been animosity between Kelly’s and his partner’s family before, during and after the incident.
’Hopefully that will be resolved in time,’ said the advocate.
’Clearly he is not a completely reformed character from his early days.
’He would perhaps welcome the assistance anger management classes would bring.
’I would submit he is not a bad person, not a thug who goes out every weekend getting drunk.
’He is simply a man who struggles to channel his emotions in the right way.’
Mrs Hughes sentenced Kelly to 16 weeks’ custody for assault causing actual bodily harm and 10 weeks for common assault, to run concurrently.
