A man who punched a customer in a takeaway has been put on probation.
Callum Thomas Radcliffe, aged 28, of North Shore Road, Ramsey, said he misheard what the man had said and this had led to the assault.
High Bailiff Jayne Hughes sentenced him to a 12-month probation order and ordered him to pay £250 compensation to his victim.
Prosecutor James Robinson told the court that the victim was in Star Grill in Parliament Street in Ramsey on April 28.
He was said to be talking to staff when Radcliffe grabbed him by the throat before punching him in the face.
Staff ejected Radcliffe and he was located by police further down the street.
Police said he appeared to be intoxicated but Radcliffe denied this.
The man was said to have suffered reddening and soreness to his face.
A probation report said that Radcliffe claimed he had misheard a comment by the victim.
He said he had not been drinking but had been taking prescription medication which could have made him appear drunk.
Radcliffe told probation he was on very strong medication after recently being stabbed in the chest and head.
He also said that he was involved in a road traffic accident about a year ago so he was on a cocktail of medication.
Prosecutor Mr Robinson said that he was prepared to give Radcliffe the benefit of the doubt and accept that he was not intoxicated.
Defence advocate Kate Alexander asked for credit to be given for her client’s guilty plea.
The advocate said: ’Mr Radcliffe has said there is no excuse for what he has done. There has been some personal difficulties with his health.
’He has indicated that, at the time of the incident, his head was not in the right place with the stabbing incident having occurred.’
Radcliffe was also ordered to pay £125 prosecution costs.
He will pay the compensation and costs at a rate of £10 per week.
