A man who had to be Pava sprayed by police to restrain him has been fined £800.
Timothy James Craine, aged 40, of Ballachrink Drive, Onchan, pleaded guilty to being drunk and disorderly and assaulting a police officer with intent to resist arrest.
Magistrates fined him £400 for each offence and also banned him from entering licensed premises, and buying or being sold alcohol for six months.
Prosecuting advocate Hazel Carroon told the court that police were called to the Archibald Knox pub in Onchan on April 23 at 7.35pm.
Craine was found drinking a pint and refusing to leave after being asked by staff.
He was said to be unsteady on his feet, smelling of alcohol, and had glazed eyes.
Craine had been ushered outside by staff but had then become involved with a group of young men in the smoking area.
Police asked him to leave but he swore and said: ’I’m not going anywhere.’
He then pushed one of the officers in the chest.
Craine then became involved in a struggle with officers which resulted in him being Pava sprayed and handcuffed on the ground.
A probation report said that Craine had mental health issues and had self-referred to the Drug and Alcohol Team (DAT).
Craine told probation he had been out for lunch with his partner then met some friends and started drinking double vodkas and moved onto tequila chasers.
He said he had then got in a taxi to go home but had jumped out in Onchan to go to another pub.
Defence advocate Paul Glover said that the assault charge related to pushing the police officer away and nothing more.
’It was not a significant strike or punch or kick,’ said the advocate
’He accepts he shouldn’t have done it. He has realised there is perhaps an issue and has sought advice from the right people.’
Magistrates also ordered Craine to pay £125 prosecution costs which he will pay, along with the fines, at a rate of £10 per week deducted from benefits.
