A 28-year-old who pushed a man through a window at Pizza Hut has been sentenced to 12 months probation.
Jonathan James Elliott, of Tynwald Road, Willaston, admitted common assault and was also ordered by magistrates to pay £125 prosecution costs.
Prosecuting advocate Roger Kane told the court that the victim flagged down police in Victoria Street in Douglas on September 13 at 3.15am.
He said that Elliott had pushed him into a window at Pizza Hut and police received a report of a broken window at the takeaway.
The victim said that Elliott had become aggressive when talking to him about a woman, swearing at him and saying: ’I’ll kill you.’
He said Elliott then grabbed him and pinned him against the window throwing him backwards through it.
When interviewed Elliott gave ’no comment’ responses to questions.
In court Elliott pleaded guilty and entered a basis of plea in which he said he had not intended to push the victim through the window, but accepted that it was reckless.
A probation report said that Elliott was studying an apprenticeship in bricklaying at University College Isle of Man.
The court heard that he had recently completed a two-year probation order and had engaged with probation well.
Elliott told probation that the victim had earlier thrown a drink over his girlfriend and he had been trying to ’smooth things out’ but it had escalated.
Defence advocate Paul Rodgers said that a custodial sentence would be a setback to Elliott’s family as he was a father of three.
Mr Rodgers asked that the court follow the recommendation of the probation report for a probation order.
Magistrates followed the recommendation and also ordered Elliott to pay the prosecution costs at a rate of £10 per week.
