A woman has been jailed for 12 weeks for an assault on her partner.

Jelena Cybka, aged 34, of Castlemona Avenue, Douglas, kicked and punched her boyfriend and bit him on the bicep, breaking the skin, during the attack.

At the start of the assault she was holding a young child in her arms, who she later put down on the floor.

High Bailiff Jayne Hughes told Cybka that this was ’an extremely aggravating factor’ saying: ’Goodness knows what that child thought was going on.’

Cybka, who works in a restaurant, admitted an offence of assault causing actual bodily harm.

The court heard that the couple had argued on June 23 and that the man had lightly pushed Cybka, which prompted her to become very angry, pulling his hair until he fell on the floor then kicking him and biting his arm.

Defence advocate Michael Mudge said: ’The argument got out of hand very quickly.

’It wasn’t a premeditated or long-lasting assault.

’She says the victim pushed her very lightly and she lost control. She admitted to police what she had done.

’She is extremely sorry.

’Ms Cybka has never been in trouble before. She has spent 11 years on the island and has now lost her good character.’

A probation report assessed Cybka as a low risk of reoffending and harm to the public.

Mrs Hughes queried the fact that Cybka was said to have been drinking but also on her way to work at 5.15pm when the incident occurred.

Mr Mudge said that Cybka admitted that she had been slightly drunk after drinking earlier in the day.

Mrs Hughes told Cybka: ’This is an extremely serious offence.’

She said that there had been a risk of the man falling on top of the child during the assault.
