The High Bailiff told a defendant she had no choice but to jail him - as there was no suitable accommodation for young offenders.
Isaac Nathan Cain, 18, was given a probation order earlier this month after admitting drunkenly breaking into a stranger’s house.
But he appeared before High Bailiff Jayne Hughes again on Thursday (June 25) via video link when he admitted breaching the order.
Probation officer Sarah Proudlove told the court that she was concerned there was no accommodation for Cain that would be appropriate for him.
Outrageous
She called him an ’intelligent’ young man who hopes to study at university.
Defence advocate Steve Wood said he was concerned for his client’s health, as the defendant was said to have anxiety.
Mrs Hughes said it was ’outrageous that we’re living in the 21st century and there is no where for a young man to live’.
She said that ’regrettably’ she was left with no choice but to give a custodial sentence.
’You wouldn’t have taken up two court appearances had you cooperated,’ she told the defendant. You didn’t and it was your choice to do so.’
Mrs Hughes added that the matter of suitable accommodation for young offenders needs to be addressed by decision makers.
Cain was given a probation order earlier this month after pleading guilty to causing damage when trying to break into a Braddan home on June 5.
The court heard that Cain, care of Isle of Man Prison, had broken two panes of glass, damaged a glass cabinet and got blood on various surfaces including a rug when entering the house.
The home owner called the police at 11.45pm and they found Cain with cuts to his hands and thighs, which were said to be ’consistent’ with being caused by broken glass.
Prison
They arrested Cain for burglary.
Prosecutor Hazel Carroon told the court that he had previously tried to enter another house nearby, but in that case he had rung the doorbell and asked to enter before being turned away by the owner.
Cain told officers he had tried to go to his dad’s house as he ’felt depressed’ while staying at Tromode House and in his drunk state, he believed he was trying to enter his dad’s home.
He was sentenced to a two-year probation order for causing criminal damage and was ordered to pay £500 in compensation to the home owner and £125 costs.
Last week Cain was given a 10-week jail sentence and his probation order was waived.
