A 32-year-old Douglas man has been sentenced to community service for threatening behaviour and cannabis possession.
Damien Aaron Nuttall, of Palace Road, pleaded guilty to both offences and was ordered to do 70 hours of unpaid work by High Bailiff Jayne Hughes.
Prosecuting advocate Rachael Braidwood told the court that Nuttall was detained by police in the Isle of Man College car park on November 6 at 10.10pm.
He was being handcuffed and tensed his arms to resist and shouting at police using the ’F’ word persistently.
His vehicle was searched and police found 1.1 grams of cannabis, valued at £33.
The court heard that he has a previous conviction in March for production (importation) of the drug to the island, for which he was sentenced to 110 hours of community service.
He has so far completed 37 hours of that order.
Defence advocate Peter Taylor said that his client had been stopped and spoken to by the police, who had decided to search his vehicle when the previous production matter showed up during their checks.
Mr Taylor said that officers had decided to handcuff Nuttall and that he had tensed up as he felt excessive force was being used.
’He accepts he was shouting and swearing,’ said the advocate.
Mr Taylor went on to say that his client was in dire financial circumstances so a further community service order may be better than a financial penalty.
High Bailiff Mrs Hughes questioned how Nuttall could afford to buy cannabis and Mr Taylor replied that he was in debt but knew that ’extravagant spending on cannabis is not appropriate’.
Mrs Hughes ordered that the 70 hours of community service begin after the previous 110 hours have been completed.
