A 45-year-old has been fined £800 for being drunk and disorderly and resisting arrest.

James Adrian Tinkler fell into a stream with a police officer during a struggle.

Magistrates fined him £400 for each offence and also ordered prosecution costs of £125.

Prosecuting advocate Harry Bellis told magistrates that police were called by a member of the public on June 8, at 9.45pm.

The witness reported that a male and female were shouting and swearing in Athol Park Glen in Port Erin.

Tinkler was said to have shouted ‘f****** c***’ at the woman he was with, and then started throwing papers from a bag into the stream.

Both were said to be drinking alcohol.

Police arrived and described Tinkler as mumbling and slurring his speech.

He was told he was being arrested, but said: ‘f*** off,’ and started to walk away.

Officers tried to put handcuffs on him, but he pushed and pulled against them.

Tinker fell over with one officer during the struggle, with them both falling into a stream.

The defendant continued to act aggressively and was taken to police headquarters.

When interviewed, he answered ‘no comment’ to all questions.

In court, Tinkler, who lives at Christian Road in Douglas, was represented in court by duty advocate Kaitlyn Shimmin.

Ms Shimmin said there had been no indication that her client caused the officer to fall into the water.

She asked for credit to be given for the defendant’s guilty pleas.

The advocate said that Tinkler, who had an appropriate adult in the dock with him, suffered from issues, but had support in place in the community.

Magistrates’ chair Julian Ashcroft told the defendant: ‘If you’re asked to do something by a police officer, you don’t resist.’

Tinkler will pay at a rate of £10 per week, deducted from benefits.
