A student whose dalek suffered significant damage after hitting a pot hole in Ramsey says he is disappointed that his claim for compensation has been dismissed.
Dr Who fan Robin Burchill, 18, created his dalek at home in Bride and took it for a test run in Mooragh Promenade, Ramsey, with girlfriend Nina, in mid-August.
The dalek suffered damage. Its head came off, its eye was smashed and the dome suffered a gouge.
Robin, who is studying automative engineering at the University of the West of England in Bristol, said that he had sought compensation to complete repairs on the Dalek.
However, he says that ’government insurers are refusing to pay out’.
Robin said he provided video evidence of a hole in the road and believes it has since been filled in.
The response to his claim from Zurich Municipal said: ’We have considered this matter thoroughly and we do not believe that our customer is liable for either the reasons you have given or at all. Our insured (the government) have informed us that they carry out inspections of the highway at the location of your incident on an annual basis.
’The last inspection of the area prior to your accident took place on November 14, 2017 and the alleged defect was not apparent at that time.’
However, the response does later refer to a defect in the road.
It continues: ’In response to your claim the area was visited on September 11. Again no defect was identified at the said location.
’We therefore do not consider the defect that caused your accident to be dangerous and we do not consider our insured to have been negligent and we deny liability.’
Robin said: ’I’m very disappointed not just because I’m going to have to try and cover the cost of repair myself but because they’ve denied that the pot hole was dangerous to other road users.
’Someone pushing a pram or riding a mobility scooter across from the promenade could’ve experienced damage or injury.’
