A drink-driver has been fined £1,000 and banned from driving for one year.

Sara Joanne Heap admitted the offence after failing a breathalyser test with a reading of 49.

Deputy High Bailiff James Brooks also ordered her to retake her test at the end of her ban.

Prosecuting advocate Hazel Carroon told the court that Heap, who lives at Fairway Close, Port Erin, was driving a Mini Cooper at Rowany Drive in Port Erin on September 5 at 10.39pm.

She was stopped by police and said to be smelling of alcohol and having glazed eyes.

After spending 10 minutes at the roadside trying to provide a sample of breath she was unable to and was subsequently taken to police headquarters.

Once there, she provided a sample and produced the reading of 49. The legal limit is 35.

Defence advocate David Clegg handed in letters of reference for his client.

Mr Clegg said that Heap’s mother had been ill and Heap, whose age was not given in court, had been at her bedside.

’Ms Heap had not been sleeping or eating which is why the reading may have been higher,’ said the advocate.

’She said she had two glasses of wine and honestly believed she was under the limit.

’There is no suggestion her driving fell below standard.

’She is deeply ashamed. No-one in the courtroom will be judging her more harshly than herself.’

Mr Clegg said that his client had no previous convictions and was losing her good character.

Deputy High Bailiff James Brooks also ordered Heap to pay £125 prosecution costs which she will pay, along with the fine, at a rate of £100 per month.
