A 32-year-old landscape gardener has been sentenced to 100 hours of community service for assaulting a pub licensee.

Daniel Kurt Moore was also ordered to pay £100 compensation to the victim after pleading guilty to the common assault.

We previously reported that police were called to the Thirsty Pigeon in Victoria Street on September 26 at 11.15pm.

Witnesses said there had been a fight inside the pub which had led to Moore being escorted out.

He was said to have made several attempts to re-enter the bar and pushed the designated official knocking him off balance, causing his glasses to fall off and injuring his finger.

Moore was arrested and when interviewed by police said a fight had started near to him in the pub so he had intervened.

He claimed he was then put in a ’choke hold’ by a member of security staff.

Moore, who lives in Rheast Barrule, Castletown, admitted he had been aggressive in trying to get back inside the bar but said he could not remember any assault.

The court heard that he had only one previous conviction in 2006.

Defence advocate Ian Kermode said: ’Mr Moore would say he rarely goes out socialising but was out for his sister’s birthday.

’He said that he tried to break up a fight and outside felt a sense of grievance. The violence used boils down to no more than a push when trying to regain entry.

’He didn’t know it was the designated official.’

Mr Kermode went on to say that his client had written a letter of apology to the victim and would also like to apologise in person.

A probation report assessed Moore as a low risk of reoffending and of harm to others.

Magistrates also ordered him to pay £125 prosecution costs which he will pay, along with the compensation, at a rate of £10 per week.
