A motorist has been jailed after driving twice in a month while he was disqualified.
Peel man Joseph Dennis Avery, of Castle Street was jailed for eight weeks despite his partner being eight months pregnant.
Sentencing him, Magistrates’ chair Lisa Horton said: ’It’s clear you have a blatant disregard for court orders.’
Prosecutor Rachael Braidwood told the court how, on November 29, Avery, 38, was banned from driving for nine months.
But on May 28 he was seen by police driving a Vauxhall Corsa up Derby Road in Peel and into Shoprite car park.
He was spoken to by police and advised the matter would be reported. However, on June 20, Avery was again seen driving by police, this time at Braddan Bridge in the same car.
He told police he was going to a doctor’s appointment.
Defence advocate Paul Glover asked for credit to be given for his client’s guilty pleas and his admissions to police.’On both occasions there was no criticism of his driving,’ said the advocate.
’He stands to lose a lot if he loses his liberty today. He stands to lose his accommodation and employment.
’Upon his release he would have to find another job and somewhere to live.
’His partner is eight months pregnant. He is the only contributor, so more people will suffer knock on effects.
’He accepts he made a very stupid mistake and has since sold the vehicle.’
Mr Glover said Avery was subject to a community service order of which he had completed 133 hours.’
He admitted both counts of the offence and two counts of having no insurance.
Magistrates chair Lisa Horton said while passing sentence: ’We give you full credit for your guilty pleas and co-operation with the police.
’However, on May 28 you blatantly breached the court order.
’What is most aggravating is that on that day you were arrested for driving whilst disqualified and barely more than three weeks later, before you were due in court you breached the order again.’
Avery was also disqualified from driving for a further 12 months.
