A man has been convicted of common assault after an incident at the Outback, in Douglas.

The prosecution allege that Joshua Anthony Brand, of Glen Road, Colby, threw a glass at a man.

But Brand, aged 24, claimed he only meant to throw the contents of the glass - and that the glass slipped.

This version of facts was not accepted by prosecutor James Robinson and a Newton Hearing will now be held to settle the dispute over the facts.

Mr Robinson said the offence took place on March 17 at 2am when Brand and the other man were on the top floor of the Outback.

The victim was talking to Brand’s ex-girlfriend but then went to the toilet.

When he returned he saw Brand talking to the woman so waited away from the pair.

Mr Robinson said Brand threw the glass, which struck the man on the forehead but didn’t smash.

Brand was escorted out by security staff and later arrested.

When interviewed, Brand told police he felt provoked because the man had been staring at him and one of the man’s friend’s had tapped him on the head earlier before insulting him in the toilets.

Defence advocate Jane Gray entered a basis of plea saying that her client did not accept intending the throw the glass, only the contents.

High Bailiff Jayne Hughes said that the difference would make a material difference to sentencing.

The court heard that Brand has no previous convictions.

A pre-Newton Hearing will be held on May 21 with bail granted in the sum of £500.
