A motorist suspected of drink-driving has been jailed after failing to supply a urine sample.

Andrew Peter Corkill, of Brookhill Road, Ramsey, was unable to provide a sample of breath or blood due to medical reasons but then refused to give a urine sample.

The 38-year-old has been jailed for eight weeks and banned from driving for five years after admitting the charge.

Deputy High Bailiff Jayne Hughes said while passing sentence: ’This is an offence which is considered more serious than actually providing the sample and failing.

’It was a flat refusal and you were asked twice at the scene and swore at police on both occasions.’

The court heard that Corkill was stopped by police after he was seen driving erratically on January 6.

When asked to provide a breath sample he twice swore at police telling them where to go.

Advocate Matthew Wilshaw said: ’Mr Corkill made the decision to drive to his father’s house for a chat.

’It wasn’t his intent to drink there but whilst there he made the decision to drink two bottles of Budweiser.

’He then made the decision to drive, clearly he shouldn’t have done so.

’Due to mental health difficulties he prefers to drive home rather than walk at night.

’He takes prescription medication which may account for his presentation at the scene as someone who was drunker than he was.

’He did swear at the police officer.

’He says it was out of frustration at what he had done. He has self-referred to the mental health team.’

Mr Wilshaw quoted a probation report which said that Corkill had not drunk for two weeks and was working with Motiv8.

He continued: ’The car was his father’s. He has now sold it. At the police station he said he was asthmatic and suffered from anxiety and panic attacks.

’The doctor assessed him as not fit for the blood test and he was offered the urine test instead.

’Due to levels of anxiety he wasn’t thinking straight and he said no.

’He was put in a cell and tells me that within five minutes he realised he should have provided the sample and has offered to do so.

’But the police will look at it, and rightly so, as delaying tactics.’

Corkill was also ordered to retake his test at the end of his ban and attend a drink-driving rehabilitation course.
