A man who assaulted his wife after he came home from an all-day drinking session has been sentenced to community service.
Tomasz Marek Piosik, of Lower Dukes Road, Douglas, slapped his wife across the face, grabbed her by the throat and punched her in the ribs.
Piosik, aged 35, admitted an offence of common assault on a female and was ordered to do 140 hours of unpaid work.
High Bailiff Jayne Hughes cited Piosik’s guilty plea, his lack of previous convictions, his good references, and his actions since the offence as reasons for sparing him a custodial sentence.
Earlier prosecutor Barry Swain told the court that Piosik had been on a drinking binge before the assault, consuming around 12 beers before getting the bus home on July 13. Piosik was said to have been drinking from 1.30pm until 9pm.
Advocate Michael Mudge handed in letters of reference and said alcohol ’totally changes’ his client’s character’. ’
He does recognise he has a problem,’ he said. ’He is engaging with Motiv8 to address his drinking. It is his intention to abstain from drinking in future.
’Thankfully there were relatively minor injuries caused. He has fully accepted responsibility for the incident and accepts the facts even for parts he can’t recall.’
Mr Mudge said the woman described her husband as a ’very good father’ who needed help with alcoholism.
He continued: ’He has been having regular contact with his children. He hasn’t moved back into the family home yet but we understand his partner is keen for him to move back in. He is the main breadwinner in the family.’
Mrs Hughes banned him from entering licensed premises, and purchasing or being sold alcohol for six months.
