A 23-year-old man has been fined £600 for resisting arrest after a racism row in a takeaway.

Rabelani Collen Nyamande, of The Level, Colby, admitted the offence with a second charge of assault causing actual bodily harm being withdrawn.

Prosecuting advocate Barry Swain told the court that the incident occurred in Marmaris takeaway on Douglas promenade on July 11 at 4.30am.

Nyamande’s girlfriend said that a man in the takeaway had made a sexist comment to her.

Nyamande was said to have confronted the man and said that he had then been racially abused with the man using the ’N’ word.

Police were called after an altercation between the two men and Nyamande was arrested after a number of warnings to calm down.

He told police: ’Why are you arresting me? Only the whites are free. Only the black kid.’

He was then said to have kicked out during his arrest, though his kicks did not strike any officer.

As he continued to struggle he was restrained using Pava spray.

The court heard that the other man involved refused to make a complaint statement.

Defence advocate Paul Rodgers said: ’There was a sexist comment towards Mr Nyamande’s girlfriend. During a confrontation the "N" word was said.

’When police arrested him he felt there was an injustice but he well understands there are better ways of dealing with this.’

High Bailiff Jayne Hughes told Nyamande: ’What was said to you was appalling. You were understandably upset but you should have reported that to police in the proper manner rather than resisting.’

He will pay the fine at a rate of £50 per month.
