A man who resisted arrest has been fined £600.
Kaan Harley Douglas, aged 29, of no fixed address, admitted the offence which was committed while he was subject to a 16-week suspended sentence, imposed for driving offences and not due to expire until March 2021.
Magistrates extended that suspended sentence until September 2021.
Douglas was said to be acting violently and damaging property at an address at Kerrowmoar.
Police reported that he appeared under the influence of a controlled substance but the occupant of the property would not make a formal complaint.
Douglas was arrested because police felt that a breach of the peace was likely if he remained at the property.
He was said to be agitated, tensing his arms and had to be restrained by two police officers as well as a civilian.
Douglas entered a basis of plea saying he was not under the influence of anything.
He admitted he had been agitated, saying that he had received some news which he did not want to go into.
Painful
Douglas said that he had broken his arm in September and it had been painful when police had grabbed his arm.
Defence advocate Stephen Wood said: ’This is an individual who was grabbed by the forearm.
’Clearly the police aren’t going to know about his injury but the natural response is to wriggle about and resist.
’We are not dealing with a case where there has been a resist following an offence being committed. There was no other offence or complaint against Mr Douglas.
’We submit there was no actual damage to any property. You are simply dealing with resisting a peace officer.
’His arm was still painful at the time.
’He reacts to that pain as many people would.’
Magistrates also ordered Douglas to pay £125 costs.
