A Peel man has been handed a suspended sentence after police had to Pava spray him three times to restrain him
David Alexander Tweedy, of Bluebell Close, admitted resisting arrest and was sentenced to four months custody, suspended for 18 months.
We previously reported that, on May 17 at 12.50am, police were called to East Quay in Peel after Tweedy, who is 27, was said to have threatened to damage his partner’s car.
The woman said that he had sent her a video of him kicking her Ford Focus.
The car was undamaged and police found Tweedy on Shore Road. He was said to be smelling of alcohol and swore at police when they tried to handcuff him.
Tweedy verbally abused police, pulling away from them as they tried to put him on the ground.
He was Pava sprayed three times as handcuffs and leg restraints were put on him.
When interviewed later Tweedy said he was walking on the promenade looking for a tobacco pouch he had dropped earlier. He admitted kicking out at police during his arrest.
The court heard that the offence put Tweedy in breach of a probation order which does not expire until November this year.
Defence advocate Deborah Myerscough said: ’Mr Tweedy has had a bit of a chequered past but his last offence is last year.
’This situation, he understands, was wholly avoidable. He had drunk too much and thought it would be a joke to do the video. Clearly that has gone wrong.
’He has made some progress in his life over the last year becoming a parent and the captain on a boat. It’s clear that supervision over the last year has worked to a degree. Custody would mean he would lose his position and his life will be a lot less stable. Prison is going to mean he goes backwards. He knows if he receives a suspended sentence it would be hanging over his head like a sword of Damocles.’
Magistrates also ordered Tweedy to pay £125 prosecution costs which he will pay at a rate of £20 per week.
