A man who pushed a victim up against a pub wall was jailed this week for six weeks.
Cesar Teodoro Simoes Maia, of Clifton Terrace, Douglas, admitted disorderly behaviour on licensed premises, which happened while he was on bail for affray.
We previously reported how, on June 29, police were called to Sam Webb’s pub, in Douglas.
The complainant in the case said he was playing a fruit machine when Maia came into the pub, grabbed his head and pushed him against a wall saying: ’I’ll kill you.’
The man told Maia he was calling the police and Maia left. Police in Regent Street were later approached by Maia who said: ’You looking for me? I only tapped him.’
In a police interview Maia, a roofer aged 35, said he had had a few arguments with the man as he was spreading gossip about him.
He said he was walking to the bank when he saw the man in Sam Webb’s. He admitted using his hand to push his head against the machine but denied assault, saying he had not intended to hurt him.
Defence advocate Stephen Wood told a court this week: ’Having viewed the CCTV footage, I would submit the incident was extremely brief. Mr Maia can be seen marching over to the gentleman and pushing him on the back of the neck with both hands.
’There was no deliberate holding of the neck. Thereafter he can be seen pulling away and both men are seen wagging fingers at each other and exchanging words. Mr Maia walks away after 10 seconds. He accepts the front of the man’s head may have come into contact with the machine or wall but it was not deliberate.’
Mr Wood said there had been tensions between the men due to rumours spread by the victim in the past.
Deputy High Bailiff Jayne Hughes said: ’You could and should have kept on walking.’
