A 33-year-old man has been convicted of property damage after admitting spitting twice while in a police van.

David William Prescott (also known as Atkinson), of Broadway, Douglas, will be sentenced on November 3 after a probation report has been prepared.

Prosecuting advocate Rachael Braidwood told the court that Prescott was arrested in relation to another matter on August 23.

He was put in a police van but as he was being transported to police headquarters he spat in the van.

He was told to stop spitting but swore and told police: ’Don’t tell me what to do. I’ll do what I want.’

He then spat in the van again.

When interviewed later Prescott said he could not remember the incident.

The court heard that he has a number of previous convictions, including ones for property damage.

The court heard that he is currently subject to a suspended sentence.

Defence advocate David Clegg asked for a probation report to be compiled before sentencing with input from mental health services.

Bail was granted in the sum of £500 with conditions that Prescott contact probation and reside at his home address.
