A 28-year-old school teacher from Douglas has been fined £750 after she hit a biker in her car on Prospect Hill in Douglas.

Jemma Louise Cornmell, of Hailwood Avenue, pleaded guilty to a charge of causing serious bodily harm by driving without due care and was also banned from driving for 12 months.

The rider suffered a fractured leg and dislocated shoulder and had to be taken to a hospital in Liverpool for surgery.

Prosecutor Barry Swain was sympathetic as he told the court: ’This is the type of incident that could happen to any one of us.’

The court heard that Cornmell had been driving down Prospect Hill at 4.50pm on November 20 intending to turn right into Athol Street.

But as she turned she failed to see a motorbike coming up the hill and there was a collision.

Mr Swain said: ’Notoriously there have been incidents there because of the layout of the road.

’She said she looked at the junction and believed she had time to make the manoeuvre. Unfortunately she didn’t see the complainant coming up the hill.

’The serious nature of the charge is simply because he suffered a fracture to his right leg and dislocated his right shoulder.

’I accept it was carried out at low speed and there is no suggestion of any dangerous driving.

’It was simply a momentary lapse of concentration.’

Cornmell attended police headquarters voluntarily and said that she had been intending to go to Tesco, admitting that she had not seen the rider.

The injured rider told police that he had been coming home from a riding lesson.

He said that it was dark and he recalled seeing the car coming down the hill but believed the driver had seen him and would stop.

Defending Cornmell in court her advocate Pamela Pringle handed in references on behalf of her client.

Ms Pringle said: ’She very much regrets causing the accident and wishes to apologise profusely for what happened to the rider.

’This has been hanging over her for months. It happened due to a mistake. It is my submission it could have happened to anyone.

’Once the accident happened she called 999 and sought help for the injured man.

’The doctor’s report said that the rider already had a pre-existing condition. His right femur already had a rod inserted which was bent as a result of the accident.

’She has a very responsible job as a school teacher and is thought highly of as you can see from her references.’

Magistrates’ chair Gill Eaton said: ’We can see it was a momentary lapse and the speed was very low.’

Cornmell must also retake her test after the ban and pay £50 prosecution costs.
