A violent thug has admitted an assault causing actual bodily harm after stamping on his victim’s head.

James Gerard Maginn was also said to have thrown multiple punches at the man and tried to choke him.

The 22-year-old, who lives in Oak Avenue, Douglas, will be sentenced on October 28 after a probation report has been completed.

Prosecuting advocate Roger Kane told the Deputy High Bailiff that Maginn got into a fight with the victim on Douglas promenade on May 30 at 11.45pm.

Maginn was said to have first pushed the victim to the ground but he then got up and followed Maginn.

This prompted Maginn to throw him to the ground again, then throw punches at him and try to choke him.

A group of people witnessing the incident pulled Maginn away but he then stamped on the victim’s head which left him unresponsive and bleeding heavily from the nose.

Emergency services arrived and police found Maginn at 12.36am when he was arrested.

He was said to have scrapes on his knees, elbows and knuckles.

When interviewed he answered ’no comment’ to all questions.

The victim did not wish to give a complaint statement.

Mr Kane submitted that the case was borderline when it came to deciding whether it should go to the higher court for sentencing, but with the guilty plea, was just about suitable to remain in summary court.

The prosecutor said that the main aggravating feature was the stamp but it was not clear whether the victim’s head was on the ground at the time that occurred.

Maginn has a previous conviction for affray, committed in April.

Defence advocate David Clegg asked for a probation report to be prepared before sentencing.

Deputy High Bailiff James Brooks accepted jurisdiction and adjourned the case until October 28.

No bail application was made.
