An uninsured driver whose unroadworthy vehicle ended up on its side following a collision at a junction has been fined £1,200.
Zdravko Benke, aged 49, of Bucks Road, Douglas, admitted driving without due care or attention, having a vehicle in a dangerous condition, and having no insurance.
His licence was endorsed with eight penalty points.
Prosecutor James Robinson told the court how, on January 8 at 2pm, police were called to an accident at the junction of Lane Road and Somerset Road.
A Nissan Vanette driven by Benke failed to stop and hit a Volkswagen Passat. The Vanette ended up on its side as a result of the collision.
Benke’s vehicle was found to have a defective tyre and rusted suspension and was taken to the test centre where it was deemed unroadworthy.
Benke’s insurance was also found to have been cancelled in September 2017.
Defence advocate Ian Kermode said of the insurance issue: ’Mr Benke struggles to read English. There was a misunderstanding.
’He received some documents and at the time of the incident he believed he was insured.
’The van was used for his building business. Regarding the defective tyre he simply had not checked it.
’With regards to the due care, he did slow down for the stop sign but accepts he accelerated away while his view was obstructed.’
’He accepts he should have edged out slowly.’
He must pay £50 costs.
